These Terms and Conditions are legally binding; it is the users responsibility to read and understand these Terms and Conditions prior to using or accessing any of our services or products.

This website is owned and operated by Onyx Interiors Edinburgh. By accessing or using our website, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Any use or modification of any materials published on this site, in full or in part, is a violation of the law and may be prosecuted. This includes but is not limited to trade dress; trade dress consists of all the various elements that are used to promote a product or service. The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Katy Innes. By using the Service, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You may use our IP with clear and unmissable credit back to our site, but cannot claim any of our IP as your own, even with clear crediting.

1. GENERAL

  • 1.1 Onyx Interiors Edinburgh registered offices: 38 East Claremont Street, Edinburgh

  • 1.2 As a Client of Onyx Interiors Edinburgh you agree to these terms and conditions when you instruct Onyx Interiors Edinburgh to complete a project or service

 

2 SERVICE TERMS

2.1 A written quotation will be provided before commencing any work, whether this is a single project or task or provision of an ongoing service. This will include fees and an estimate of realistic timescale for completion. This must be agreed before any work starts

  • 2.2 If Onyx Interiors Edinburgh is unable to deal with any request, we will inform you as soon as is reasonably practical.

  • 2.3 If a Client's details or requirements change from the lime of engagement then these should be put in writing.

  • 2.4 In the event that the Client requires Onyx Interiors Edinburgh to carry out or arrange for services to be performed at a particular location the client must give reasonable access to the location for the service concerned to be completed

  • 2.5 Onyx Interiors Edinburgh will make every effort to complete a service or task. However they will not be liable if a service or task cannot be completed for reasons beyond their control leg. strike, transport difficulties, act of god, war, riot, malicious damage, accidental breakdown of equipment, flood, fire, storm or other unforeseen circumstance).

  • 2.6 Special Deals and Sales such as Black Friday - Any sale prices or special deals shall refer to the purchase of a one-off specified

3 SERVICES BY THIRD PARTIES

3. 1 Completion of some services may involve services by a supplier or a third party. Every effort will be made to ensure that suppliers are reputable and trustworthy.

  • 3.2 Suppliers' charges for the relevant services will be payable by the Client directly, unless agreed otherwise.

  • 3.3 Suppliers are responsible for providing the Client with the services or products concerned. Onyx Interiors Edinburgh will not be responsible for the actions of suppliers

  • 3.4 Clients are responsible for agreeing any suppliers' terms and conditions.

 

4 SPECIFIC SERVICE ISSUES

4.1 A number of specific issues are referenced below. This is not an exhaustive list, but highlights some important points.

4.2 Provision of information

4.2.1 Having carried out research for the Client, Onyx Interiors Edinburgh provides the information in good faith. It is always the Client's decision as to whether to act on this or not. Onyx Interiors Edinburgh cannot therefore accept any responsibility for the consequences of such decisions

4.3 Production of documents

4.3.1 Onyx Interiors Edinburgh will always aim to provide a quality service and ensure any document is accurate and error free. Final proof reading is the responsibility of the Client. Anything that requires correction must be notified to Onyx Interiors Edinburgh within 5 working day of the Client's receipt of completed work and will be rectified free of charge.

4.4 Handling of possessions

4.4.1 When handling Client's possessions Onyx Interiors Edinburgh will always take great care. Nevertheless, accidents may occur. We shall not be liable for losses or damage, however they are caused.

4.5 Removal/ sale of items

4.5.1 Onyx Interiors Edinburgh are happy to make suggestions about the disposal of unnecessary or unwanted items and in doing this to sort through items. We can arrange for removal and disposal to potential agents or buyers, but will not be able to guarantee a rate.

4.6 Gift Vouchers

  • 4.6.1 Gift Vouchers may be purchased for a part or full package. The Voucher must be signed and dated by Onyx Interiors Edinburgh or is otherwise void.

  • 4.6.2 Gift Vouchers are valid for 6 months from date of purchase or if won as a prize, valid from date of prize draw.

  • 4.6.3 Gift vouchers which are won as part of a raffle or prize draw should be assumed to refer to an ONLINE consultation. Onyx Interiors Edinburgh reserves the right to offer an ON-SITE consultation if the property in question is within reasonable travelling distance

 

5 BUSINESS HOURS

5.1 Onyx Interiors Edinburgh normal business hours are from 10.00 – 16.00 Monday to Friday excluding all UK Bank Holidays. Where Onyx Interiors Edinburgh is requested to provide services outside these hours and Onyx Interiors Edinburgh is able to meet this request, then Onyx Interiors Edinburgh will charge for its services. This rate will be agreed in advance with the Client.

 

6 CHARGES

6. 1 Interior Design Packages are available. See website: www.onyxinteriorsedinburgh.co.uk for more information

6.2 Where the service carried out by Onyx Interiors Edinburgh requires more time than allowed for within the Package deal, additional time will be charged by the hour. The minimum period for each instruction is 1 hour. The hourly rate is £40 per hour. This will be agreed with the client before proceeding

  • 6.3 Onsite visits/ meetings, following the initial meeting, and out with the Package Deal but which are requested by the client to complete the service will be billed as meeting time.

  • 6.4 Travel time 1o or from your premises will be included in the hourly rate. Mileage to your premises is included in the hourly rate within a 5 mile radius of Bruntsfield, Edinburgh. Additional mileage will be charged at a rate of 45p per mile. Onyx Interiors Edinburgh reserves the right to charge you for reasonable travel time.

  • 6.5 Reasonable expenses will be added to quotes to cover additional items such as, car parking charges, postage etc as appropriable.

Receipts will be provided along with your invoice.

6.6 Onyx Interiors Edinburgh reserves the right lo charge for any changes made by the client io the scope of the original agreement. This will only be done after consultation with the Client.

 

7 INVOICES & PAYMENT TERMS

  • 7.1 On completion of the service Onyx Interiors Edinburgh will provide the Client with an invoice. The invoice will include a list of services with any additional charges incurred.

  • 7.2 Invoices must be paid by the client within 14 working days of the date of issue, unless there is an agreement made prior to the end of the 14 working days.

  • 7.3 In the event of a late payment i.e. payment is not received within 14 working days, a penally of 5% of the total invoiced will be payable to Onyx Interiors Edinburgh

  • 7.4 Alter the 5% penalty in the first month of late payment, overdue invoices will be subject to a monthly service charge of 5%

 

8 PAYMENT METHODS

  • 8.1 Payment may be made by bank transfer or cheque. Cheques will need to be paid to Emma Hoyle

  • 8.2 In the event of any cheque being refused by the bank, the client will be responsible for all bank charges resulting from returned cheque.

 

9 WEBSITE & EMAILS

  • 9.1 Onyx Interiors Edinburgh takes reasonable precautions to ensure that their website, emails and documents are free from viruses, but this cannot be guaranteed

  • 9.2 Where there are links to third party websites Onyx Interiors Edinburgh cannot accept any responsibility for the information contained in these sites. Neither can it guarantee that it is virus free.

10 CONFIDENTIALITY

  1. 1 Confidentiality and discretion are guaranteed at all times.

  2. COMPLAINTS POLICY

  • 11.1 Onyx Interiors Edinburgh endeavours at all times to provide a high quality service. However, we ask that Clients advise us if they have any concerns and we will respond to the complaint as soon as possible, but within 7 working days of receipt.

  • 11.2 Onyx Interiors Edinburgh ask that in the event of the Client making a complaint about the service provided by any third party the Client service provided by suppliers.

  • shall copy the complaint to Onyx Interiors Edinburgh, so the performance of the third party and take reasonable steps to ensure the quality of 12 INSURANCE

  • 12.1 We have professional indemnity and public liability.

  • 13 TERMINATION OF CONTRACT

  • 13.1 Either the Client or Onyx Interiors Edinburgh are entitled to terminate a contract on 4 weeks written notice to the other.

 

 

SALES AND RETURNS

 

BESPOKE CURTAINS AND BLINDS

All balances must be cleared before final fitting can be arranged or any goods are released. Payment of deposit is considered as a contract between Onyx Interiors Edinburgh and yourself. Where measurements are customers own, Onyx Interiors Edinburgh will not be responsible if measurements are incorrect. All product details must be checked by the customer prior to placing the order. Lead times are 6-8 weeks, if a product is out of stock then we will notify you immediately, this may affect lead times. Please note fitting price may vary depending on any remedial work necessary to complete correct and secure fittings.

 

 

RETURNS

 

We have a 14-day return policy, which means you have 14 days after receiving your item to request a return. To be eligible for a return, your item must be in the same condition that you received it, unused and in its original packaging. You’ll also need the receipt or proof of purchase. Please note that returns will need to be taken to the following address: Onyx Interiors Edinburgh, Studio 38, 38 East Claremont Street, Edinburgh, EH7 4JR. 

Damages and issues 
Please inspect your order upon reception and contact us on hello@onyxinteriorsedinburgh.co.uk immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.Goods that have experienced reasonable wear and tear will not be considered faulty. The item is considered your responsibility until it reaches us. Therefore, for your own protection we recommend that you send the parcel using a delivery service that insures you for the value of the goods.

Exceptions / non-returnable items 
Certain types of items cannot be returned, like custom products 

  • Products which have been personalised for you

  • Made-to-order or measure products, for example any cut merchandise such as fabrics, linens, curtains, blinds

  • We are not under obligation to accept return of surplus wallpaper rolls that have been ordered in error

This does not affect your statutory rights.
Unfortunately, we cannot accept returns on sale items.

 

EXCHANGES

REFUNDS

If approved, you’ll be automatically refunded on your original payment method within 7 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too. 

If more than 15 business days have passed since we’ve approved your return, please contact us at hello@onyxinteriorsedinburgh.co.uk

 

SHIPPING

To return your product by post, please contact us at hello@onyxinteriorsedinburgh.co.uk and we will advise on shipping details. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. Depending on where you live, the time it may take for your exchanged product to reach you, may vary. We recommend using a trackable shipping service or purchasing shipping insurance, as we can't guarantee that we will receive your returned item if there is no tracking.

 

We may amend these terms and conditions from time to time at our discretion without notice to you. Any amendments will be posted here and will supersede any terms and conditions previously published by us.

Our Site is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.
